The RvR system in Warhammer takes place through varying types, some open, some instanced, some in RvR areas within a zone etc. The standard ruleset server will only allow for pvp however for those who are flagged based upon RvR areas and the pvp is optional - you can avoid those areas on the map and remain unflagged.
I believe they will launch with an open pvp ruleset server more akin to EQ2 where there are level caps for the open zones in addition to the regular RvR areas. If so, this is where I'll be :)

Theo The offical Warhammer site (Click the second movie on the menu) has a really good video on the main screen that discusses the way the RvR siege system works, it looks interesting because it has 4 levels that the good/evil have to attain before a zone control point becomes theirs, but the thing I found MOST interesting is that the first stage begins with PvE quests and such. So even though some people may not like PvP they still influence the world as a whole. Thats pretty cool.

Latest word I have found is that an open RvR server will definitely be in at launch. I do not think they will cap the pvp however like EQ2. Instead if you gank a lowbie you will be transformed into a literal chicken and will be nerfed terribly - this to encourage griefing of all chickens in the world. That is priceless!
